This is the license agreement for the BRB ecash software, the US version. Please read it carefully and proceed with downloading the software only if you agree with the license agreement.

THIS IS A LEGAL AGREEMENT TO WHICH YOU ARE CONSENTING TO BE BOUND. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS LICENSE, DO NOT USE THE SOFTWARE.

The ecash-software is only available to beta-testers participating in the DigiCash experiment known as "BRB".

The downloaded software is licensed only for and will be used only for your internal testing as part of the aforementioned experiment, subject to all the terms and conditions of this Agreement, and will not be sublicensed or made available to any third party or used directly or indirectly for revenue generating or commercial purposes. It has to be treated as confidential material, and shall not be reverse-engineered (except to the extent applicable law expressly prohibits reverse engineering restrictions), modified or copied.

Participation in the trial is on a voluntary basis, DigiCash BV can not be charged for any costs as a result of participating in the trial. Any found bugs can be reported to ecash-bugs@digicash.com, but DigiCash BV is not obliged to fix them. All software distributed during the trial will remain property of DigiCash BV, Amsterdam, The Netherlands. The downloaded software is only licensed for use with the Ecash BRB Mint, located at dc.digicash.com:8666.

The licensee is reponsible for compliance with any export control laws and regulations and represents and warrants that it has obtained all necessary approvals and authorization prior to downloading. In particular, but without limitation, none of the Software or underlying information or technology may be downloaded or otherwise exported or reexported (i) into (or to a national or resident of) Cuba, Haiti, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria or any other country to which the U.S has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. By downloading or using the Software, you are agreeing to the foregoing and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list.

THIS SOFTWARE IS A BETA TEST VERSION AND IS PROVIDED GRATUITOUSLY AND ON AN "AS IS" BASIS, WITH ALL FAULTS AND WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. ACCORDINGLY, THE ENTIRE RISK REGARDING QUALITY, FAILURE, LOSS OF DATA AND NONPERFORMANCE AND ALL COSTS RELATING TO DEFECTS ARE ON THE LICENSEE, NOT DIGICASH OR ANY LICENSOR AND NEITHER DIGICASH NOR ANY OF ITS AFFILIATES OR LICENSORS WILL BE LIABLE UNDER ANY CONTRACT, NEGLIGENCE OR OTHER THEORY FOR ANY INCIDENTAL AND CONSEQUENTIAL DAMAGES OR ANY DIRECT DAMAGES.

This software is not licensed to governmental entities or for government purposes and may not be downloaded or used by any such entity or for any such purposes.
